Can affiliated companies be consolidated into one BE-45 report?

One BE-45 survey should be completed on behalf of the consolidated domestic U.S. Reporter. The fully consolidated domestic U.S. enterprise consisting of (i) the U.S. corporation whose voting securities are not owned more than 50 percent by another U.S. corporation, and, proceeding down each ownership chain from that U.S. corporation, (ii) any U.S. corporation whose voting securities are more than 50 percent owned by the U.S. corporation above it. The fully consolidated domestic U.S. enterprise excludes foreign branches and other foreign affiliates.

How should transactions with international organizations be reported on the BE-45?

International organizations (such as the United Nations, the World Bank, and the International Monetary Fund) are, according to balance of payments conventions, considered foreign entities, even if they are headquartered in the United States. Insurance transactions with these organizations should be reported on the BE-45.

My company has insurance transactions with a U.S. affiliate of a foreign company. Are these transactions reportable on the BE-45?

No. U.S. affiliates or U.S. subsidiaries of foreign companies are considered U.S. persons for the purposes of this survey. Any transactions between your company and U.S. persons are not reportable on the BE-45.

My company has insurance transactions with our foreign parent. Are these transactions reportable on the BE-45?

Yes. Transactions with your company’s foreign parent are considered foreign transactions and should be reported on the BE-45 survey in the sections labeled “Foreign Parent(s) and Other Members of the Foreign Parent Group (FPG)”. Reinsurance transactions should be reported on Schedule A2. Primary insurance and auxiliary insurance transactions should be reported on Schedule B2.

My company provides insurance services to one of our foreign affiliates. Is this reportable on the BE-45?

Yes. Transactions with your company’s foreign affiliates are considered U.S.-to-foreign transactions and should be reported on the BE-45 in the sections labeled “Foreign Affiliates”. Report reinsurance transactions with foreign affiliates on Schedule A1. Report primary and auxiliary insurance transactions with foreign affiliates on Schedule B1.
